Terms of use
These terms apply when you use africompliance.com, africompliance.co.ke and the AfriCompliance app (the "service"). AfriCompliance ("we", "us") is operated by NANO AI Agency, Kenya. By using the service you agree to these terms. If you do not agree, please do not use it.
1. What the service is — and is not
AfriCompliance helps farmers, agronomists, co-operatives, packhouses and exporters screen pesticide use against market rules, keep farm records and prepare for shipments and audits.
- It gives guidance. It is not a laboratory test, an official inspection, a certification, or legal or agronomic advice.
- Waiting periods come from product labels. Residue limits and bans come from public sources: the EU Pesticides Database, Kenya PCPB, China MARA and US EPA lists (see africompliance.com/data). They can change, and our copy may lag behind.
- Official documents — for example phytosanitary certificates and certificates of origin — are issued only by the relevant authorities.
Please read the disclaimer, which forms part of these terms.
2. Your account
- You must be at least 18 years old, or use the service with the permission of an adult responsible for the farm or business.
- Give accurate details. You sign in with one-time codes; keep them private and do not share your phone or email access with others.
- You are responsible for activity on your account. Tell us at once at info@africompliance.com if you think someone else has used it.
3. Your records
- Farm records you enter (sprays, fertilizer, water tests, workers, harvests and so on) remain yours.
- You allow us to store and process them only to run the service for you — including creating reports and PDFs you request — as described in our privacy policy.
- You are responsible for the accuracy of what you record. Keep your own copies of anything you need for audits or buyers.
4. Compliance records and QR codes
The PDF spray record with a QR code is a self-declared record based on what you entered. You must not present it as an accredited certificate, alter it after it is generated, or create records you know to be false. A buyer who scans the QR code sees the record as it was generated.
5. Acceptable use
You must not:
- enter false records, or use the service to mislead buyers, authorities or auditors;
- access other people's accounts or farm records, or try to get around security or rate limits;
- copy the database in bulk, scrape the service, or overload it;
- upload anything unlawful or harmful, or use the service to break any law.
We may suspend or close accounts that break these rules.
6. Price and changes
The checks and farm records described on our homepage are free for farmers. We may add paid features in future; we will tell you before anything you use stops being free, and you will never be charged without agreeing first. We may change or stop parts of the service, and will give reasonable notice where we can.
7. Availability
We work to keep the service available and accurate, but we cannot promise it will always be online, error-free or up to date. Keep your own records for anything time-critical.
8. Liability
Nothing in these terms limits rights you have under Kenyan law that cannot be limited, including under the Consumer Protection Act, 2012.
To the extent the law allows, we are not responsible for decisions you make using the service — including rejected or destroyed consignments, lost sales, or penalties — and not for indirect or consequential losses. Where we are liable, our total liability is limited to the amount you paid us for the service in the 12 months before the claim.
9. Closing your account
You can stop using the service at any time and ask us to delete your account by emailing info@africompliance.com. Some records may be kept for a limited time where the law requires it, as set out in the privacy policy.
10. Changes to these terms
We may update these terms. We will change the date at the top, and for important changes we will tell you in the app or by email before they take effect.
11. Law and disputes
These terms are governed by the laws of Kenya. If you have a complaint, please contact us first so we can try to resolve it. If we cannot, disputes will be handled by the courts of Kenya.
